Lumi is operated by Digital Ventures Partners (DVP), a French société par actions simplifiée (SAS) with share capital of €2500, having its registered office at 122 rue Amelot, 75011 Paris, France, registered with the Paris Trade and Companies Register under number 951 762 228 (RCS Paris 951 762 228). By creating an account, downloading the Lumi app, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You must be at least 16 years old (or the minimum age required to consent to processing of personal data in your country, whichever is higher) to use the Service. If you are between 16 and the age of majority in your country, you confirm that your parent or legal guardian has reviewed and accepted these Terms.

The Service is not directed to children under 16, and we do not knowingly collect data from them.

Lumi is a self-improvement and education tool that helps you practise public speaking, communication, and confidence through:

• Recorded speaking exercises analysed by speech-recognition and AI systems;
• Real-time conversational AI agents and voice coaching;
• Articles, video lessons, book summaries, daily insights, and gamified challenges;
• A structured "Journey" with milestones, badges, and progress tracking.

Not professional advice. Lumi is for personal training and entertainment. It is not therapy, medical, psychological, legal, or career advice and is not a substitute for a qualified professional. AI outputs (scores, tips, transcripts, recommendations) may be inaccurate, incomplete, or biased. You are responsible for how you use them.

You need an account to use most features. You agree to:

• Provide accurate information when you sign up;
• Keep your login credentials confidential;
• Be responsible for all activity that happens through your account;
• Notify us promptly at support@dvp.digital if you suspect unauthorised use.

You may delete your account at any time from the in-app settings or by contacting us. Deletion is described further in our Privacy Policy.

6.1 Plans

Lumi offers paid plans that unlock access to premium features. The available plans, prices, billing periods, and any free trial duration are shown to you on the purchase screen before you confirm the purchase.

6.2 Purchases through the Apple App Store (iOS in-app purchases)

If you purchase a subscription through the iOS app, the following applies, in addition to Apple's standard terms:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
• You can manage and cancel subscriptions by going to your Apple ID account settings after purchase.
• Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• Refunds for App Store purchases are handled by Apple under their refund policy; we cannot issue refunds for App Store transactions directly.

6.3 Purchases through our website

If you purchase a subscription on our website, payment is processed by our payment provider. The price shown at checkout includes any applicable taxes unless otherwise indicated. By confirming the purchase, you authorise us and Stripe to charge your selected payment method on a recurring basis where the plan is recurring.

You can cancel a recurring web subscription at any time from your account page or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access until then.

6.4 Free trials

Some plans may include a free trial. Unless you cancel before the trial ends, your subscription will automatically convert into a paid subscription at the rate shown at sign-up. You are responsible for cancelling on time if you do not wish to continue.

6.5 Price changes

We may change subscription prices for future billing periods. We will give you reasonable advance notice and, where required by law, your explicit consent before applying a price change to your subscription.

6.6 Right of withdrawal (EU/EEA consumers)

If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal for subscriptions purchased directly from us on the web. Because Lumi provides digital content and services that you access immediately, you expressly request that we begin providing the Service during the withdrawal period, and you acknowledge that you lose your right of withdrawal once the Service has been fully performed. Where the Service has only been partially performed when you withdraw, you may still withdraw and we may charge you an amount proportionate to what you have already used. This does not apply to purchases made through the Apple App Store, which are governed by Apple's own terms and refund policy.

Lumi works by recording your voice and analysing what you say. By using the Service, you understand and agree that:

• Audio you record is sent to our servers and to specialised third-party providers (speech-to-text, AI language models, text-to-speech, conversational AI) for processing and scoring.
• Transcripts and metrics about your speech (clarity, pace, energy, confidence, etc.) are stored in your account to track your progress.
• AI outputs can be wrong. Scores, tips, and coaching messages are produced by automated systems and may contain mistakes, biases, or inappropriate suggestions.
• You are responsible for not recording confidential, sensitive, or unlawful content (for example, secrets covered by professional confidentiality, the personal data of other people without their consent, threats, harassment, or illegal content).

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose;
• Upload, record, or transmit content that is illegal, defamatory, harassing, hateful, sexually explicit, or that infringes someone else's rights;
• Use the Service to harm minors in any way;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by mandatory law;
• Use bots, scrapers, or automated tools to access the Service or to overload our infrastructure;
• Use the Service or AI outputs to build a competing product, train a competing model, or otherwise misappropriate our intellectual property;
• Share, resell, sublicense, or grant access to your account or paid content to anyone else.

We may suspend or terminate accounts that breach these rules.

9.1 Our content

The Service, including its name, logo, design, illustrations, text, video lessons, book summaries, exercises, AI prompts, and software, is owned by DVP or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use.

9.2 Third-party content

Some content (videos of public speakers, book summaries, quotes, illustrations) may be provided under licence or used in a manner permitted by applicable copyright exceptions. All third-party trademarks and content are the property of their respective owners.

9.3 Your content

You retain ownership of the audio you record and any text you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, analyse, transcribe, store, and display your content for the purpose of operating and improving the Service, subject to our Privacy Policy. We will not use your raw voice recordings to train generally available AI models without your separate opt-in consent.

The Service relies on third-party providers (e.g., Apple App Store, RevenueCat, Microsoft Azure, OpenAI, ElevenLabs, Supabase, Resend…). Your use of those services may also be governed by their own terms and privacy policies. We are not responsible for third-party services or content, but we choose providers we believe are appropriate for the Service.

From time to time we may offer experimental or beta features. They are provided "as is", may change or be removed at any time, and may not work as expected. You agree to give us feedback in good faith and to keep beta features confidential where we ask.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will meet your expectations. Nothing in these Terms limits any non-waivable consumer rights you have under the law of your country of residence.

To the maximum extent permitted by law, DVP, its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Where liability cannot be excluded but can be limited, our total aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) EUR 100.

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

To the extent permitted by law, you agree to indemnify and hold DVP and its affiliates harmless from any claims, losses, damages, and costs (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or of a third party's rights.

We may suspend or terminate your access to the Service if you breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would create legal, security, or operational risks.

You may stop using the Service and delete your account at any time. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

We may update the Service, add or remove features, or change these Terms from time to time. If we make material changes, we will notify you in advance through the app, by email, or on our website. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, you should stop using the Service and may cancel your subscription as described above.

These Terms are governed by French law, without regard to its conflict-of-laws rules. The competent courts of France will have jurisdiction, except where consumer protection rules of your country of residence grant you the right to bring proceedings in your own courts or under your own law.

If you downloaded the Lumi app from the Apple App Store, the following terms apply between you and Apple:

• These Terms are concluded between you and DVP, not with Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide any maintenance or support for the Service.
• If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• DVP, not Apple, is responsible for addressing any claims relating to the Service, including product liability, legal or regulatory non-compliance, and consumer protection claims.
• DVP, not Apple, is responsible for the investigation, defence, settlement, and discharge of any third-party intellectual property infringement claim relating to the Service.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Scope of License. The license granted to you for the Lumi app is a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be accessed by other accounts associated with you via Family Sharing or volume purchasing, where applicable.
• Developer contact. The app is provided by Digital Ventures Partners (DVP), 122 rue Amelot, 75011 Paris, France. Any questions, complaints, or claims regarding the app should be directed to DVP at that address or by email at support@dvp.digital.
• Third-party terms. You must comply with any applicable third-party terms of agreement when using the app.
