These Terms govern your use of the Lumi mobile application, web app, and related services (collectively, the "Service"), operated by Digital Ventures Partners under the brand Lumi. Please read them carefully before using Lumi.

By creating an account, downloading the Lumi app, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You must be at least 16 years old (or the minimum age required to consent to processing of personal data in your country, whichever is higher) to use the Service. If you are between 16 and the age of majority in your country, you confirm that your parent or legal guardian has reviewed and accepted these Terms.
The Service is not directed to children under 16, and we do not knowingly collect data from them.

Not professional advice. Lumi is for personal training and entertainment. It is not therapy, medical, psychological, legal, or career advice and is not a substitute for a qualified professional. AI outputs (scores, tips, transcripts, recommendations) may be inaccurate, incomplete, or biased. You are responsible for how you use them.
You need an account to use most features. You agree to:
You may delete your account at any time from the in-app settings or by contacting us. Deletion is described further in our Privacy Policy.
Lumi offers paid plans that unlock access to premium features. The available plans, prices, billing periods, and any free trial duration are shown to you on the purchase screen before you confirm the purchase.
If you purchase a subscription through the iOS app, the following applies, in addition to Apple's standard terms:
If you purchase a subscription on our website, payment is processed by our payment provider. The price shown at checkout includes any applicable taxes unless otherwise indicated. By confirming the purchase, you authorise us and Stripe to charge your selected payment method on a recurring basis where the plan is recurring.
You can cancel a recurring web subscription at any time from your account page or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access until then.
Some plans may include a free trial. Unless you cancel before the trial ends, your subscription will automatically convert into a paid subscription at the rate shown at sign-up. You are responsible for cancelling on time if you do not wish to continue.
We may change subscription prices for future billing periods. We will give you reasonable advance notice and, where required by law, your explicit consent before applying a price change to your subscription.
If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal for subscriptions purchased directly from us on the web. Because Lumi provides digital content and services that you access immediately, you expressly request that we begin providing the Service during the withdrawal period, and you acknowledge that you lose your right of withdrawal once the Service has been fully performed. Where the Service has only been partially performed when you withdraw, you may still withdraw and we may charge you an amount proportionate to what you have already used. This does not apply to purchases made through the Apple App Store, which are governed by Apple's own terms and refund policy.
Lumi works by recording your voice and analysing what you say. By using the Service, you understand and agree that:

We may suspend or terminate accounts that breach these rules.
The Service, including its name, logo, design, illustrations, text, video lessons, book summaries, exercises, AI prompts, and software, is owned by DVP or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use.
Some content (videos of public speakers, book summaries, quotes, illustrations) may be provided under licence or used in a manner permitted by applicable copyright exceptions. All third-party trademarks and content are the property of their respective owners.
You retain ownership of the audio you record and any text you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, analyse, transcribe, store, and display your content for the purpose of operating and improving the Service, subject to our Privacy Policy. We will not use your raw voice recordings to train generally available AI models without your separate opt-in consent.
The Service relies on third-party providers (e.g., Apple App Store, RevenueCat, Microsoft Azure, OpenAI, ElevenLabs, Supabase, Resend…). Your use of those services may also be governed by their own terms and privacy policies. We are not responsible for third-party services or content, but we choose providers we believe are appropriate for the Service.
From time to time we may offer experimental or beta features. They are provided "as is", may change or be removed at any time, and may not work as expected. You agree to give us feedback in good faith and to keep beta features confidential where we ask.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will meet your expectations. Nothing in these Terms limits any non-waivable consumer rights you have under the law of your country of residence.
To the maximum extent permitted by law, DVP, its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
Where liability cannot be excluded but can be limited, our total aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) EUR 100.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.
To the extent permitted by law, you agree to indemnify and hold DVP and its affiliates harmless from any claims, losses, damages, and costs (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or of a third party's rights.
We may suspend or terminate your access to the Service if you breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would create legal, security, or operational risks.
You may stop using the Service and delete your account at any time. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.
We may update the Service, add or remove features, or change these Terms from time to time. If we make material changes, we will notify you in advance through the app, by email, or on our website. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, you should stop using the Service and may cancel your subscription as described above.
These Terms are governed by French law, without regard to its conflict-of-laws rules. The competent courts of France will have jurisdiction, except where consumer protection rules of your country of residence grant you the right to bring proceedings in your own courts or under your own law.
